These Terms of Service govern your access to and use of fxpxs.com, including any purchases made through the website.

Throughout these Terms, “For Pete’s Sake,” “we,” “us” and “our” refer to For Pete’s Sake®. By visiting the website, creating an account, submitting information or purchasing a product, you agree to these Terms and the policies referenced within them.

Please do not use the website or place an order unless you agree to these Terms.

1. Online Store Terms

You must be at least the age of majority in your state, province or country of residence to use this website or place an order.

You may not use our products, website or services for any unlawful, fraudulent or unauthorized purpose. You may not interfere with the operation or security of the website or violate any applicable laws while using it.

2. Products and Availability

We make reasonable efforts to display product descriptions, colors, images, measurements and other details accurately. Screen settings, lighting and photography may cause colors or details to appear differently in person.

Products may be produced in limited quantities and may sell out without notice. We reserve the right to modify, discontinue, limit or refuse the sale of any product at any time.

Availability displayed on the website is subject to change. Adding an item to your cart does not reserve it.

3. Pricing and Payment

Prices are displayed in the currency shown at checkout and may change without notice.

Applicable taxes, shipping charges and other permitted costs will be displayed before you complete your purchase.

We reserve the right to correct pricing, product or promotional errors. If an error affects an order you have already placed, we may contact you for instructions or cancel and refund the affected order.

Payment must be authorized before an order is processed. Payment information is handled by Shopify and the payment providers available at checkout.

4. Orders

An order confirmation does not guarantee acceptance of an order. We reserve the right to refuse, limit or cancel an order when reasonably necessary, including in cases involving:

• Suspected fraud or unauthorized payment
• Incorrect pricing or product information
• Inventory errors
• Orders intended for unauthorized resale
• Violation of these Terms
• Shipping restrictions or other circumstances that prevent fulfillment

If we cancel an order after payment has been collected, the amount charged for the canceled merchandise will be refunded to the original payment method.

You are responsible for providing complete and accurate billing, shipping and contact information. Please review your information carefully before submitting an order.

5. Shipping and Delivery

Please allow 1–2 business days for order processing. Orders placed on weekends or holidays begin processing on the next business day.

Estimated delivery times after shipment are:

• United States: 3–5 business days
• Canada: 5–10 business days
• International: 10–20 business days

Delivery times are estimates and are not guaranteed. Carrier delays, customs processing, weather, incorrect addresses and circumstances outside our control may affect delivery.

Tracking information will be sent to the email address used at checkout when available.

International customers are responsible for customs duties, taxes, import fees and other charges imposed by their destination country.

6. Final Sale Policy

All sales are final.

We do not accept returns or exchanges for changes of mind, incorrect sizing, fit, color or personal preference. Customers are responsible for reviewing product descriptions, measurements and sizing information before placing an order.

Claims involving damaged, defective or incorrect items must be submitted to info@fxpxs.com within 15 days of delivery.

Approved claims may be resolved with a replacement when available or a refund to the original payment method. Items must not be returned without prior authorization.

Our complete terms are available in the Final Sale Policy. Nothing in these Terms limits any consumer rights that cannot legally be waived.

7. Lost, Stolen or Misdelivered Packages

You are responsible for providing a complete and accurate delivery address.

Once a shipment has been transferred to the carrier, delivery is subject to the carrier’s tracking and delivery procedures. Contact us promptly if tracking shows a delivery problem, and we will help review the available information.

We are not responsible for delays or losses resulting from an incorrect address supplied by the customer. Any replacement or refund involving a lost, stolen or misdelivered package will be determined based on the circumstances, carrier documentation and applicable law.

8. Promotions and Discount Codes

Promotions, discount codes and special offers may be subject to separate terms, expiration dates and product restrictions.

Unless expressly stated otherwise:

• Discounts cannot be combined.
• Discounts do not apply retroactively.
• Promotions have no cash value.
• We may modify or end a promotion at any time.
• Promotional errors may be corrected or canceled.

9. Intellectual Property

All website content—including trademarks, logos, product names, designs, artwork, photographs, graphics, text, videos, packaging and website elements—is owned by or licensed to For Pete’s Sake® and is protected by intellectual-property laws.

You may view the website and purchase products for personal, noncommercial use. You may not reproduce, copy, modify, distribute, publish, sell, license, exploit or create derivative works from our content without prior written permission.

Purchasing a product does not transfer ownership of any trademark, copyright, design or other intellectual-property right.

10. User Content and Submissions

When you voluntarily submit photographs, reviews, comments, messages, tags or other content to us, you confirm that:

• You own the content or have permission to submit it.
• The content does not violate another person’s rights.
• The content is not unlawful, misleading, abusive or malicious.

We may remove or decline to publish submitted content at our discretion.

We will not publicly use customer photographs or creative work for advertising without permission, except where use is reasonably implied by the method of submission, such as participating in a clearly identified promotional campaign or tagging the brand for repost consideration.

11. Third-Party Services and Links

The website may include services, applications, payment options or links provided by third parties, including Shopify, payment processors, shipping carriers, social platforms and analytics providers.

We are not responsible for the content, availability, security or practices of third-party websites or services. Your use of those services may be governed by separate terms and privacy policies.

Notify us promptly if you believe your account has been accessed without authorization. We may suspend or close an account when reasonably necessary to protect the customer, the store or other users.

Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded or limited.

To the extent permitted by law, you agree to indemnify and hold For Pete’s Sake® harmless from third-party claims, losses or expenses arising from your unlawful use of the website, your violation of these Terms or your infringement of another party’s rights.

These Terms, together with the Privacy Policy, Shipping Policy, Final Sale Policy and any other policies displayed on the website, constitute the agreement governing use of the store and purchases made through it.
